Welcome to QuestSpark. These Terms of Service (“Terms”) are a legal agreement between you and QuestSpark (“QuestSpark,” “we,” “us,” or “our”) governing your use of the QuestSpark mobile application and the questspark.appwebsite (together, the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and the parent or legal guardian of each child profile you create in the app. Children may only use QuestSpark under your account and with your supervision. You are responsible for all activity that happens under your account, including your children’s use of the Service.
2. Your account
You can sign in with Apple, Google, or an email and password. You agree to provide accurate information, keep your login credentials private, and notify us promptly if you suspect any unauthorized use at djolezizou@gmail.com.
3. How you can use the Service
We grant you a personal, non-exclusive, non-transferable, revocable license to use QuestSpark for personal, non-commercial family use. You agree that you will not:
- Reverse-engineer, decompile, or attempt to extract source code from the app.
- Use the Service to harass, harm, or exploit any child, including your own.
- Upload content that is illegal, sexually explicit, violent, hateful, or that infringes another person’s rights.
- Try to access other families’ data, probe our infrastructure, or interfere with the Service’s operation.
- Use the Service in violation of any applicable law, or Apple’s App Store terms.
4. Your content
You and your children may upload content to QuestSpark — quest names, emojis, reward descriptions, and submission photos or audio. You keep ownership of that content. You grant QuestSpark a limited license to store, display, and process your content solely to operate the Service for your family (for example, showing a submission photo to a parent for approval). We do not use your content to train AI models or for advertising.
You are responsible for the content your family uploads. Please do not submit photos or audio that show other people without their consent, or that include sensitive information such as identification documents, credit cards, or medical records.
5. In-app coins and rewards
Coins and rewards inside QuestSpark are a family-tracking feature with no monetary value. They cannot be exchanged for real money, purchased, or transferred between families. You decide what a coin is worth in your household and how rewards are fulfilled. QuestSpark is not a party to the arrangements you make with your child about rewards.
6. Purchases and subscriptions
If we offer paid features, they are sold through Apple’s App Store and governed by Apple’s standard terms. Subscriptions, if any, auto-renew unless you cancel at least 24 hours before the end of the current period via iOS Settings → [your name] → Subscriptions. Refunds are handled by Apple; please contact Apple Support for refund requests.
7. Third-party services
QuestSpark runs on Apple’s iOS platform and uses Google Firebase for authentication, data storage, and push notifications. Your use of those platforms is also subject to the providers’ own terms and privacy policies.
8. Privacy
Our Privacy Policy explains what information we collect and how we use it. By using QuestSpark, you agree to the practices described there.
9. Availability and changes
We work hard to keep the Service up and running, but we do not guarantee uninterrupted availability. We may add, change, or remove features, and we may require you to update the app to continue using it. If we make significant changes to these Terms, we will notify you in-app or by email before they take effect.
10. Suspension and termination
You can stop using QuestSpark at any time and delete your account from Settings. We may suspend or terminate your account if you violate these Terms, if required by law, or if your continued use poses a security or safety risk to other families. Sections intended to survive termination (ownership, disclaimers, limitations of liability, dispute resolution) will continue to apply.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. QUESTSPARK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. QUESTSPARK IS A HOUSEHOLD TRACKING TOOL; IT IS NOT A REPLACEMENT FOR PARENTAL JUDGMENT.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUESTSPARK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF USD $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
13. Indemnification
You agree to defend, indemnify, and hold harmless QuestSpark and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your violation of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. Any dispute arising out of or relating to the Service or these Terms will be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction there. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property rights.
15. Apple-specific terms
If you downloaded QuestSpark from the Apple App Store, the following also applies: these Terms are between you and QuestSpark, not Apple; Apple has no obligation to provide maintenance or support for the app; Apple is not responsible for any product claims, including product liability, legal compliance, or intellectual property claims; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
